APPLICATION

Any order of products sold by SCEA ROGER-CONSTANT LEMAIRE implies unconditional acceptance by the buyer of our General Terms and Conditions of Sale.
The buyer must be of legal age to consume alcoholic beverages. Online sales may be governed by specific General Terms and Conditions of Sale available on our online store.
Any modification of our General Terms and Conditions of Sale must be expressly accepted in advance and in writing by us.
If a specific agreement derogates from one of the provisions of these General Terms and Conditions of Sale, the other provisions shall remain applicable.
Unless expressly accepted in writing by us, our General Terms and Conditions of Sale invalidate any differing or opposing clause appearing on the buyer’s documents or correspondence, as the buyer’s general purchasing conditions cannot, under any circumstances, be enforced against SCEA ROGER-CONSTANT LEMAIRE.
Subject to applicable law, SCEA ROGER-CONSTANT LEMAIRE reserves the right to modify its prices and its General Terms and Conditions of Sale at any time, with the new prices taking effect one (1) month after publication.
The fact that SCEA ROGER-CONSTANT LEMAIRE does not invoke any provision of these General Terms and Conditions of Sale shall not be interpreted as a waiver of its right to do so later.
If any provision of these General Terms and Conditions of Sale is declared null, illegal, or unenforceable in whole or in part, the remaining provisions shall remain in full force and effect.
These General Terms and Conditions of Sale are personal and non-transferable.

ORDERS

Non-professional customers have a 15-day withdrawal period (except for purchases made on the premises, at fairs or exhibitions, or for personalized products) and are responsible for return shipping costs. They are responsible for proper storage and return shipment of the goods.

INCOTERM

Unless otherwise stipulated, our prices are based on FCA F-51700 Villers-sous-Châtillon.
Thus, unless otherwise provided in writing in the price list, products travel at the recipient’s risk, even in the case of carriage-paid shipments. 

AVAILABILITY TIMEFRAMES

The availability times indicated when ordering are given for information only and will be met insofar as product availability allows. However, delays in availability shall not justify order cancellation, damages, or penalties.
Cases of force majeure (strikes, supply difficulties, etc.), unforeseen events, or similar circumstances release us from any delivery obligation without compensation.

TRANSPORT

In the event of apparent damage, the recipient must state reservations on the transport document before accepting delivery. Please refer to our full GTCs for details.

PRICES

Prices listed by SCEA ROGER-CONSTANT LEMAIRE are exclusive of VAT but include CRD, unless otherwise stated, and are provided for information only.
They may be modified at any time with one (1) month’s notice.
Any order will be invoiced according to the conditions in the price list in force on the date of shipment.
Discounts may be applied successively to the base prices.
In case of an increase in the applicable VAT rate or the value of the C.R.D., duty-included prices will be adjusted accordingly for all shipments made from the effective date of the new rates/duties.

PAYMENT TERMS

Orders intended for export are payable in cash before pickup, or within thirty net days if previously agreed in writing.
Orders within France are payable in cash before pickup or, if previously agreed in writing, in accordance with the Law of 31 December 1992 and the NRE Law of 15 May 2001.
The fixed indemnity for recovery costs and late payment penalties are defined by the LME Law of 4 August 2008.
Regardless of any reservations made by the buyer upon receipt of the products (including breakage), the portion of the delivery received in good condition and in conformity with the order must be paid at the agreed price and according to the payment terms stated in the order.

RETENTION OF TITLE

SCEA ROGER-CONSTANT LEMAIRE retains ownership of the delivered products until full payment of the principal and ancillary amounts. However, from the moment the products are delivered or made available, the buyer bears all risks, including loss, theft, damage, or destruction of products subject to retention of title, as well as any damage they may cause.

Personal data provided to SCEA ROGER-CONSTANT LEMAIRE is processed in strict compliance with applicable regulations; in particular, it is not transferred or disclosed outside SCEA ROGER-CONSTANT LEMAIRE.
